Terms of Use

1. About RatedJavea

RatedJavea is an online platform designed to help people find and connect with local professionals and service providers in Jávea/Xàbia and surrounding areas.

In these Terms, "RatedJavea", "we", "us" and "our" refer to the operator of the RatedJavea platform.

These Terms apply to customers and other people using RatedJavea to search for professionals, post service requests or otherwise use the customer-facing parts of the platform. Professionals are additionally subject to the Professional Terms.

2. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to create a customer account or post a service request through RatedJavea.

You must provide accurate information when creating an account or posting a request. You are responsible for keeping your login details secure and for activity carried out through your account.

3. What RatedJavea does

RatedJavea provides a marketplace that helps customers discover and connect with independent professionals and businesses.

Customers can post requests describing services they need. RatedJavea may use information such as the requested service, service area, language and timing to identify potentially suitable professionals.

Relevant professionals may then choose whether to respond. RatedJavea currently limits the number of active professional responses presented to a customer at one time. Customers may decline a professional, allowing another suitable professional to respond where one is available.

RatedJavea does not guarantee that a request will receive a response or that a suitable professional will be available.

4. RatedJavea is not the service provider

Unless expressly stated otherwise, RatedJavea does not perform the services advertised or requested through the platform. Professionals using RatedJavea operate independently.

When you choose a professional, any agreement for plumbing, gardening, building, cleaning, legal, accounting, transport, personal, property or other services is between you and that professional. RatedJavea is not a party to that service contract.

The professional is responsible for agreeing with you matters including:

• the scope of the work;

• price;

• timing;

• payment;

• warranties;

• licences or qualifications where required;

• insurance where appropriate; and

• resolving issues concerning the work.

You should satisfy yourself that a professional is appropriate for your requirements before engaging them.

5. No payment for jobs through RatedJavea

RatedJavea does not currently process customer payments for services provided by professionals. Prices, quotations and indicative prices provided by professionals are between the customer and professional. Payment for the underlying service takes place independently of RatedJavea.

6. Posting a request

When posting a request, you must provide information that is accurate and reasonably sufficient for professionals to understand what you require.

You must not post:

• requests for illegal services;

• fake or deliberately misleading requests;

• requests intended to harass or deceive another person;

• duplicate or spam requests;

• content that infringes another person's rights;

• unnecessary personal or sensitive information;

• malicious files or content; or

• requests designed to manipulate RatedJavea's reviews, matching or

response systems.

We may reject, restrict, close or remove requests that breach these Terms or our Community Guidelines.

7. Matching

RatedJavea uses automated rules and scoring to determine which professionals may be relevant to a request.

Factors may include the service requested, category, service area, language, availability and other marketplace information.

Matching is intended to improve relevance. It is not a recommendation, endorsement or guarantee that a professional is suitable. Not every potentially suitable professional will necessarily receive every request.

8. Professional responses

A professional may respond with information including a message, availability or timescale and an indicative price.

A response does not require you to hire that professional. You are responsible for deciding which, if any, professional to select.

You may decline a professional response. A declined professional cannot subsequently be selected for that request through the normal RatedJavea process.

9. Contact information

Before you select a professional, RatedJavea does not provide your private customer contact details to responding professionals.

When you choose a professional, your relevant contact information may be shared with that professional so that you can arrange the service.

Central RatedJavea administrators may access information where reasonably necessary for platform administration, security, support, dispute handling or legal compliance. Administrative access may be logged.

10. Reviews

After a service arranged through RatedJavea has been recorded as completed, an eligible customer may leave a Verified Job review.

A Verified Job review means the review is connected to a service relationship recorded through RatedJavea. It does not mean RatedJavea has independently inspected or certified the quality of the work.

Reviews must reflect the reviewer's genuine experience. You must not submit fake, incentivised, defamatory, abusive or deliberately misleading reviews.

RatedJavea may moderate or hide reviews that breach these Terms, the Community Guidelines or applicable law. Reviews may display the customer's first name. Users may report reviews for moderation.

11. Professional information and verification

Information displayed on professional profiles may be supplied by the professional.

Unless specifically stated otherwise, RatedJavea does not currently perform formal identity, qualification, licence, insurance or business-document verification.

A "Founding Professional" designation identifies participation in RatedJavea's founding programme. It is not an endorsement or professional certification.

A "Verified Job" relates to a job completed through the RatedJavea marketplace and does not constitute identity verification.

Customers should conduct any checks appropriate to the type and value of work they are commissioning.

12. Your responsibilities

You agree to use RatedJavea lawfully and respectfully. You must not attempt to:

• gain unauthorised access to accounts or data;

• scrape or harvest information at unreasonable scale;

• interfere with platform security;

• manipulate reviews or marketplace metrics;

• impersonate another person;

• misuse professional contact details;

• introduce malicious software; or

• use RatedJavea for fraud or unlawful activity.

13. Reporting content

You may report certain requests, professional profiles and reviews to RatedJavea. A report does not automatically cause content to be removed. RatedJavea may investigate and take action where appropriate.

14. Account restriction

We may restrict, suspend or terminate access where reasonably necessary because of:

• serious or repeated breaches of these Terms;

• fraud or suspected fraud;

• security threats;

• abuse of other users;

• unlawful activity;

• manipulation of the marketplace; or

• legal or regulatory requirements.

Where appropriate, we may give the user an opportunity to explain or resolve the issue.

15. Availability of RatedJavea

We aim to provide a reliable service but cannot guarantee uninterrupted or error-free availability. We may modify, suspend or discontinue features where reasonably necessary for maintenance, security, legal compliance or development of the platform.

16. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including rights that cannot legally be excluded under applicable consumer law.

Subject to those rights, RatedJavea is an intermediary marketplace and is not responsible for performing the underlying services arranged between customers and professionals.

We do not guarantee:

• the quality of a professional's work;

• that information supplied by a professional is complete or accurate;

• that a professional will respond;

• that a customer will hire a professional;

• that quoted prices will remain unchanged; or

• the outcome of a customer-professional relationship.

These provisions are not intended to remove any statutory rights you may have.

17. Professional conduct, loss and damage

Professionals are independent service providers. RatedJavea does not supervise or control how a Professional performs the underlying service and does not assume responsibility merely because the introduction was made through RatedJavea.

Subject always to liability that cannot lawfully be excluded or limited, RatedJavea is not responsible for loss arising from a Professional's acts or omissions, including defective or negligent work, property damage, theft, fraud or other criminal conduct, failure to attend or complete work, insolvency or disappearance, overcharging, breach of contract, or loss of money paid directly to a Professional.

If you believe a Professional has committed theft, fraud, threats, serious property damage or other potentially criminal or dangerous conduct, you should contact the appropriate emergency service, police, insurer or other authority where necessary and report the incident to RatedJavea. RatedJavea may suspend access, preserve relevant platform records and cooperate with lawful requests from competent authorities where appropriate.

18. Deposits, advance payments and insurance

RatedJavea does not currently collect, hold, safeguard or protect payments for the underlying services arranged through the marketplace.

Any deposit, advance payment or other payment made directly to a Professional is made at the customer's own discretion under the customer's agreement with that Professional. Before making a significant payment, customers should consider obtaining a written quotation or contract and checking the Professional's identity, business details and appropriate insurance or credentials where relevant.

Unless expressly stated otherwise, RatedJavea does not guarantee that a Professional carries insurance or that any insurance will cover a particular loss.

19. Intellectual property

RatedJavea and its platform design, branding, software and original content are protected by applicable intellectual-property laws.

You retain ownership of content you submit. By submitting content for publication or marketplace operation, you grant RatedJavea a non-exclusive licence to host, store, reproduce and display that content to the extent reasonably necessary to operate, promote and improve RatedJavea.

21. Changes to these Terms

We may update these Terms. The current version and effective date will be displayed on RatedJavea.

Where a material change affects existing users, we may provide notice and, where appropriate, require acceptance of the updated Terms. Previous versions may be retained for audit purposes.

22. Governing law

These Terms do not remove mandatory consumer protections that apply to you based on where you live. Subject to any mandatory rights that apply, these Terms are governed by the laws applicable to the operator of RatedJavea.
